Dealing with medical malpractice

On Behalf of | Aug 28, 2016 | Firm News, wrongful death

Patients visit healthcare facilities to get properly diagnosed and treated. Occasionally health care professionals might make errors that can cause further injury to the patient. Medical malpractice is the negligence of a healthcare provider leading to further injury. There are several laws in place that allow patients to take legal action against the healthcare provider for negligence.

Patients may take legal action against any health care professional involved in their treatment. This includes nurses, doctors or hospital staff. Patients have the right to sue the entire healthcare facility if their fault is established. Compensation may be claimed for any physical and mental suffering. After leaving the facility, patients can only file for malpractice for a limited amount of time. This is called the prescriptive period and each state has its own prescriptive period.

There are two important factors that need to be established during medical malpractice cases. Patients need to determine who was at fault and then prove it in court. Legally proving fault in such cases is difficult, and might require the testimony of another healthcare professional who feels their peer was negligent.

To prove negligence, patients must establish that the healthcare professional had a duty towards them which they did not perform up to the required standards. The negligence must be linked to the injury that was perpetrated on the patient. Without proving that the injury was caused due to the carelessness of the healthcare professional, patients may not get compensation.

If you feel that you are a victim of medical malpractice, you may want to contact an attorney to file for compensation. An attorney will assess your case and help you in filing the claim.
